Can Blue Ivy Name Be Used Again

'Blueish Ivy,' the trademark: Feds move fast on rights to Beyoncé and Jay-Z's baby's name

Thinking of cashing in on the Beyoncé baby boom? Too tardily! That train has already left the station, only four weeks after footling Blue Ivy Carter was born.

In the superstar industrial circuitous, trademarking your infant's name is just smart business organisation. In that location all sorts of folks who might effort to slap it on some tacky baby bib.

To wit: Fashion designer Joseph Mbeh, who submitted an application to trademark "Blue Ivy Carter NYC" on Jan. 11 — merely four days after the baby was born. Another applicant filed on January. 20 for "Blue Ivy Carter Celebrity 4" to use on a line of fragrances. The trademark office has already denied both filings, proverb the proper name belonged to a "very famous infant " and consumers would falsely assume that the products were approved past the celebrity parents.

Mbeh, who intended to produce children's dresses, skirts, and underwear using the proper name, issued a groveling statement later his Jan. 25 smackdown from the feds. A big misunderstanding!: He planned to pitch the idea to Beyoncé and Jay-Z and never, always, intended to poach any of their baby bucks.

The application past BGK Trademark Holdings — Beyoncé's company — is pending but is basically a done deal considering parents are legally authorized to trademark the names of their pocket-sized children, experts say.

However, some in the field have raised an eyebrow over the unusual swiftness with which the feds accept taken activity on the Blue Ivy filings. Did the superstar parents and occasional White House visitors become special treatment?

A typical trademark application takes three to four months, explained Chris Ott, a trademark chaser with Vorys, Sater, Seymour and Pease. It's unremarkably first come, first serve, with a long, long line. Information technology's worth the wait: A trademark identifies the source of goods and services and protects business organisation from unauthorized apply of potentially valuable brands. "You can make a ton of money with t-shirts," said Ott.

But it's not a given that Blue Ivy was fast-tracked considering of her connections. In fairness, the folks at the trademark office follow the news only like the remainder of the states.

The office gets thousands of applications a year —398,667 in 2011 — and most end up in what we'll call the normal (slow) line. Only now and and then a proper noun or phrase emerges in the culture — "Shock and Awe," "The Situation," "Occupy," "one%," "99%" — and the office sees a sudden fasten in filings.

"The agency will place actual or potential filing trends for trademarks with similar test issues," explained Cynthia Lynch, ambassador for trademark policy and procedure. All those zeitgeisty applications get pulled aside and channeled to examiners who can inquiry and quickly dominion upon similar filings. When Blue Ivy was born, officials anticipated the proper noun would evidence up and were ready to bat down imposters.

Except. . . for one lucky boutique in Sturgeon Bay, Wisconsin. The wearable shop "Blue Ivy" filed for trademark on Jan. nineteen, 2011 (before Beyonce was even pregnant) and received approving on Aug. 23. The store owners now have the right to apply that name on their store, Web site and related items as long as they want. Or they can sell the trademark if, say, some multimillionaire star made an offering.

Reps for Beyoncé and Jay-Z didn't respond to requests for comment.
